The Nature and origin of Torts

Today, i have invested my day in learning about the nature and origin of torts.

From what i got to know so far:

Tort is derived from a latin word ‘tortrum’. It’s meaning is ‘to twist’.

‘Tort’ means ‘ a conduct which is not straight or lawful but, on the other hand, twisted, crooked and unlawful.

The law imposes a duty to respect the legal rights vested in the members of the society and the person making a breach of that duty is said to have done the wrongful act.

This means that to respect the right of person A is the duty of person B and vice versa.

If any of them, either person A or B, commits a wrongful act against the other one. Then it will be taken under law of tort.

For example: trespassing, negligence, defamation, deceit, etc.

The origin of ‘tort’ is from the common law system of england. From the two catchall categories.  (1) writ of trespass (2) writ of trespass on the case.
